The state asks for a qualified swimming pool treatment operator once a pool passes 3,000 square feet. Westchester County asks at 1,000. That single number pulls a large number of association, school and hotel pools into a requirement their operators may believe does not reach them.

Westchester's Article XII does not restate the state code; it adds to it. The additions cluster around two things the state leaves lighter — who must be qualified to run the pool, and what a hotel or campground has to be able to prove it told its guests.
The operator-certification threshold is 1,000 square feet of surface area, where state Subpart 6-1.21 sets it at 3,000. Gas-chlorine pools are covered at any size. A qualified operator means completion of a NYS DOH Water Treatment Plant Operator Certification Course Type A or B, or an adequate equivalent course.
All pools larger than 1,000 square feet in surface area or pools disinfected using gas chlorine shall be maintained by a qualified swimming pool treatment operator within one year of the effective date of this section.

Even pools under five feet deep and 2,000 square feet or less must provide poolside supervision by someone 18 or older holding a current CPR/AED for the Professional Rescuer certification — with a certification period not exceeding one year, so it renews annually rather than every two or three.

Pool and beach operators must acquire and operate an AED under a written collaborative agreement with an emergency health care provider, post its location, maintain it, keep records of its use, and ensure someone on site has completed a training course within the preceding twenty-four months of the current season.

A 25-yard by 40-foot rectangle is 1,000 square feet. Plenty of association, school and hotel pools sit just above that line and well below the state's 3,000, which means the operator-certification requirement applies where a reading of the state code alone would say it does not.
Training sessions signed and kept three years, and patron notice delivery logged by name and room number for three years. That is a longer retention than the state's twelve-month operating record, on a category of record the state does not ask for at all.
A Safety Plan review every two months through the operating season is something that has to be scheduled, evidenced and signed — the kind of obligation that is quietly missed precisely because nobody owns the calendar for it.
The supervision certification at small pools is capped at a one-year period. A guard or attendant on a two-year CPR cycle is out of compliance in year two without anything visibly changing.
Under §873.1202, a Westchester pool larger than 1,000 square feet requires a qualified swimming pool treatment operator — so a 1,400 square foot pool is above that line even though it is well under the state's 3,000.
